That is if the counsellor is truly knowledgeable and experienced. There are only so many options available to a consumer for debt relief. If the consumer is to far behind or cannot afford the payments in this type of program, then there is also available a debt settlements program, in which the debts are settled for hopefully much less than they owe at face value. As usual, I always screen out for the least painful <a href="http://americandebtenders.com"target= _blank>Personal Debt Management</a> approach, meaning, that which will be the least disruptive to their credit, etc. After reviewing the credit card debts, and working up a quote for a non-profit credit card consolidation program, it turned out that the consumer would be saving about 100.00 dollars per month, even after the monthly fee was factored in and a ton of money in interest charges. <p><b>Thinking this was a no brainer enrollment</b> I sent the quote. only to be met with whether or not the payment could be made lower, and the program extended because the new budget after the separation would be very tight. The question was, if the payment could be brought down by 68.00 dollars per month, they would immediately enroll. So, I explained that this was simply not possible, and that the banks were unyielding in their terms for this type of program. <p><b>What to do? What to do?</b> Well, I suggested reviewing the monthly expense budget and trying to find what amounted to a 2.25 cents savings per day. This, to prevent a default on their payments, and allow them to save a ton of money in interest. After all, was, realistically was the alternative? <p><b>This is what I call missing the forest for the trees.</b> The question was not unreasonable, nor the desire to bring the payment down further, but, it happens all the time, that after running up a very large debt, regardless of the reasons, some consumers simply want it all their own way. I agree, that the banks caused a great deal of this misery, to begin with, by charging such insanely high interest rates in the first place. But, the fact is, that the best solution, is learn from your mistakes and bite the bullet, and get rid of the debt. If you have spoken with a credit counselor and determined Bankruptcy is the only option for you, then you should seek legal advice from a bankruptcy attorney. <p><b>The following is intende to be legal information only.</b> And, as such, it is an overview on the basics of the 2 most common bankruptcy types. <p><b>For prsonal Bankruptcy, there are 2 different types.</b> that a consumer may consider: Chapter 7 or Chapter 13. On October 17, 2005, the bankruptcy code was revised by the “Bankruptcy Abuse Prevention and Consumer Protection Act.” [BAPCPA] This change was intended to eliminate the option of Chapter 7 Bankruptcy for people who could afford to repay some of their debts. As of 2005,in order to qualify for Chapter 7, a client’s expenses must be examined using the government’s “means test” which was introduced as part of the 2005 change to the law. This means test analyzes a client’s income versus expenses local living standards, and the median income for the client’s state. <p><b>Chapter 7: “No asset” bankruptcy </b>– In this type of bankruptcy, You do not have to pay any portion of your debts. <p> To qualify for a Chapter 7, first a client must obtain Consumer Credit Counseling from an organization approved by the US Trustee’s office within 180 days of filing. The credit counseling is intended to see if the client has realistic alternatives to filing for bankruptcy. <p>A client must pass the “means test.” This is the measure of disposable income left over monthly, if they cannot pass the means test for their state, then they can only qualify for a hapter 13. This is a 5 year repayment plan of the consumers debt with the oversight of a Bankruptcy trustee. Rather than take this option, <a href="http://www.americandebtenders.com/debt-settlement-strategy.html" target="_blank">DEBT SETTLEMENTS</a> might be a better option to consider, if the only issue is unsecured debt. <p> Most bankruptcy attorneys require you to pay their fees up front in full before they will process your bankruptcy. Fees vary by state. <p>A bankruptcy will remain on your credit report for up to ten (10) years. <p>Chapter 13: “Repayment Plan” bankruptcy – You must repay a portion of your debts. Chapter 13's can be more costly. <p>- The court will analyze your income and expenses, and set the client up on a repayment plan with their creditors typically for 3 to 5 years. <p>- A bankruptcy Trustee is appointed by the courts and monitors and administrates your repayment plan. <p><b>If you cannot file a chapter 7 bankruptcy,</b> you may be much better off entering a valid <a href="http://www.americandebtenders.com" target="_blank"> Debt Settlement Program</a> , administrated by a law firm. The debt settlement program will not be listed on your credit report, you will not need to be involved with the courts, and a chapter 13 is really a court ordered settlement program.
